1. Scope and Seller

These General Terms and Conditions (“Terms”) apply to orders and contracts concluded through the ANN PERICA online store at annperica.com and, where agreed, directly with ANN PERICA.

By placing an order, the customer accepts these Terms in the version applicable at the time of purchase.

2. Products and Product Representation

ANN PERICA offers fine jewelry, including handcrafted, made-to-order and custom-made pieces, as well as jewelry featuring natural gemstones, natural diamonds, lab-grown diamonds and lab-grown gemstones.

We make every reasonable effort to represent our products, colors, materials, gemstones and proportions accurately. However, colors and appearance may vary depending on the customer's screen and device settings. Product images are based on photographs of the actual jewelry and may be professionally retouched or digitally enhanced, including with the assistance of AI-based tools. Such editing does not alter the essential characteristics, materials or design of the product.

Natural gemstones and diamonds are unique products of nature. Variations in color, inclusions, structure and appearance are natural characteristics and do not constitute a defect unless expressly agreed otherwise.

Minor variations may also occur in handcrafted jewelry as a natural result of the artisanal production process.

3. Prices

Prices are displayed in the currency selected in the online store and include Swiss VAT at the applicable rate, unless otherwise stated.

Any applicable shipping costs will be displayed separately before the order is completed.

For deliveries outside Switzerland, the applicable tax treatment may vary depending on the destination country. International orders may also be subject to import duties, customs charges, local taxes or other fees imposed by the destination country. Unless expressly included or collected during checkout, such charges are the responsibility of the customer.

4. Orders and Conclusion of Contract

The presentation of products in our online store generally constitutes an invitation to place an order.

By completing the checkout process, the customer submits a binding order.

An electronic order confirmation will be sent after receipt of the order. Unless the confirmation or circumstances indicate otherwise, the contract is concluded upon ANN PERICA's acceptance of the order.

ANN PERICA reserves the right to decline or cancel an order for legitimate reasons, including obvious pricing errors, lack of availability, suspected fraud or inability to fulfil the order. Any payment already received will be refunded in such circumstances.

5. Payment

Available payment methods are displayed during checkout.

Payment is generally due when the order is placed unless otherwise expressly agreed.

Payments may be processed by third-party payment providers, whose additional terms may apply.

6. Made-to-Order and Custom-Made Jewelry

Many ANN PERICA pieces are made to order. Production times stated on individual product pages are estimates.

Custom-made pieces are produced according to specifications agreed with the customer.

Changes to an already confirmed custom order are only possible where the stage of production permits. Additional costs resulting from requested changes may be charged to the customer.

Ownership of the fully paid physical jewelry piece passes to the customer. Any intellectual property rights in designs, drawings, models and design concepts remain with ANN PERICA to the extent permitted by law, unless otherwise agreed in writing.

ANN PERICA may photograph or film custom-made jewelry for portfolio, communication and marketing purposes, provided that no personal information identifying the customer is disclosed. Personal engravings or other identifying elements will not be published without prior consent.

7. Delivery and Collection

Estimated production and delivery times are stated on the relevant product page or communicated as part of the order.

For made-to-order and custom-made pieces, production and delivery times begin once all necessary specifications have been confirmed and, where applicable, the required payment has been received.

Unforeseeable circumstances, force majeure or events outside ANN PERICA's reasonable control may extend delivery times. Customers will be informed of material delays.

Where available, orders may be collected from the ANN PERICA showroom in Zurich. Proof of identity and/or order confirmation may be required upon collection.

8. Right of Withdrawal and Returns

Customers in Switzerland

Swiss law does not generally provide a statutory cooling-off or withdrawal period for online purchases.

Where ANN PERICA voluntarily offers a return or exchange policy, the return conditions published on our website at the time of purchase apply.

Consumers in the European Union

Where the statutory EU right of withdrawal applies, consumers generally have the right to withdraw from a distance contract without giving a reason within 14 days after receiving the goods.

To exercise this right, the consumer must inform ANN PERICA of the decision to withdraw by means of a clear statement within the applicable period.

The customer bears the direct cost of returning the goods where permitted by law and unless ANN PERICA expressly agrees otherwise.

The right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalized.

Depending on the degree of customization, this may include custom-made jewelry, personalized jewelry and engraved pieces.

Statutory rights relating to defective goods remain unaffected.

9. Returns

Before returning an item, customers are requested to contact info@annperica.com.

Except where a product is returned because of a defect, returned products must be unworn, undamaged and complete with any accessories and original packaging.

Mandatory statutory rules apply to returns made under a statutory right of withdrawal.

10. Warranty and Two-Year Guarantee

ANN PERICA stands behind the quality and craftsmanship of its jewelry.

ANN PERICA jewelry is covered by a two-year guarantee from the date the product is received against manufacturing and material defects, unless otherwise expressly agreed.

This commercial guarantee does not affect any mandatory statutory rights. Swiss consumer law generally provides a two-year limitation period for warranty claims relating to defective goods. EU consumers are entitled to a minimum two-year legal guarantee for new goods, and national law may provide additional protection.

The ANN PERICA guarantee covers proven manufacturing and material defects.

The commercial guarantee does not cover, in particular:

• normal wear and tear;
• damage caused by improper use, accidents or impact;
• improper storage or care;
• exposure to chemicals or other damaging substances;
• alterations or repairs performed by third parties not authorized by ANN PERICA;
• loss, theft or loss of individual components unless resulting from a manufacturing defect covered by the guarantee.

Natural characteristics and individual features of gemstones and diamonds do not constitute manufacturing or material defects.

Where a valid guarantee or statutory warranty claim exists, ANN PERICA will, depending on the circumstances and applicable law, repair or replace the piece or provide another remedy required by law.

11. Care, Repairs and Alterations

Jewelry is delicate and should be treated with appropriate care.

To the extent permitted by law, ANN PERICA is not responsible for damage resulting from improper handling or from repairs or alterations carried out by unauthorized third parties.

Repairs, resizing and other services outside the guarantee may be offered for a fee following individual assessment.

12. Liability

ANN PERICA remains liable in accordance with mandatory applicable law.

To the extent permitted by law, liability is excluded for damage resulting from slight negligence, improper use or circumstances outside ANN PERICA's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory applicable law.

13. Intellectual Property

All website content, including texts, photographs, videos, designs, logos, graphics, product names, drawings and design concepts, is owned by ANN PERICA or used with appropriate authorization to the extent protected by applicable intellectual property law.

Reproduction, commercial use or distribution without prior permission is prohibited unless permitted by law.

14. Privacy

Information on how ANN PERICA collects, processes and protects personal data is provided in our Privacy Policy, available on our website.

15. Governing Law and Jurisdiction

These Terms and any contractual relationship between ANN PERICA and the customer shall be governed by Swiss law.

If the customer is a consumer, this choice of law shall not deprive the customer of any mandatory consumer protection rights granted by the laws of the country in which the customer has their habitual residence, where such laws are applicable and cannot be excluded by agreement.

The applicable statutory rules on jurisdiction shall remain unaffected. Where a choice of jurisdiction is legally permitted, the courts of Zurich, Switzerland, shall have jurisdiction.

16. Changes to These Terms

ANN PERICA may amend these Terms for future orders. The version applicable at the time the contract is concluded governs the relevant order.
